Acceptance of Terms

By accessing or using PromptGuru, you confirm that you are at least 13 years of age (or the applicable minimum age in your country), that you have the legal capacity to enter into these Terms, and that you agree to comply with them in full.

Description of the App

PromptGuru is a free Flutter mobile application that uses artificial intelligence to generate business-oriented image prompts, helping users create professional visuals. The App is provided free of charge and is supported by in-app advertising.

License to Use

Grant of License

Subject to these Terms, DezCoder grants you a limited, non-exclusive, non-transferable, revocable license to install and use PromptGuru on your mobile device for personal, non-commercial purposes.

Restrictions

You agree not to:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use the App for any unlawful purpose or in violation of any applicable laws
• Use the App to generate prompts for content that is illegal, harmful, defamatory, or infringing on third-party rights
• Interfere with or disrupt the integrity or performance of the App or its servers
• Attempt to gain unauthorized access to any systems or networks connected to the App

AI-Generated Content

Nature of AI Output

The image prompts generated by the App are produced by artificial intelligence and are provided for informational and creative assistance purposes only. We do not guarantee the accuracy, originality, or suitability of any generated prompt for any particular purpose.

Your Responsibility

You are solely responsible for how you use the generated prompts. You must ensure that any images created using these prompts comply with applicable laws and do not infringe upon intellectual property rights, privacy rights, or any other rights of third parties.

No Intellectual Property Claims on Prompts

We do not claim ownership over prompts you generate using the App. However, you acknowledge that similar prompts may be generated for other users and we make no warranty of uniqueness.

Advertising

PromptGuru is offered free of charge and is supported by advertising. By using the App, you consent to the display of advertisements served by third-party advertising networks, including Google AdMob.

We are not responsible for the content of third-party advertisements displayed within the App. Any engagement with ads is at your own discretion and risk.

Intellectual Property

The App, including its design, graphics, code, logos, trademarks, and all related materials, are the exclusive property of DezCoder or its licensors and are protected by applicable intellectual property laws. The name "PromptGuru" and the DezCoder brand are proprietary marks.

Nothing in these Terms grants you any rights to use our trademarks, logos, or other proprietary marks without our prior written consent.

Third-Party Links & Services

The App may contain links to third-party websites or services. These links are provided for convenience only. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Disclaimer of Warranties

PromptGuru is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The App will be error-free or uninterrupted
• The results obtained from using the App will be accurate or reliable
• Any defects or errors will be corrected

Limitation of Liability

To the maximum extent permitted by applicable law, DezCoder and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities.

In no event shall our total liability to you for all claims exceed the amount you have paid us in the twelve (12) months preceding the claim, or USD $10, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless DezCoder and its affiliates from and against any claims, liabilities, damages, losses, costs, or expenses arising out of your use of the App, your violation of these Terms, or your violation of any rights of a third party.

Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your license to use the App will immediately cease.

Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which DezCoder operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DezCoder with respect to the App and supersede all prior agreements and representations.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will indicate the date of the latest revision at the top of this document. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
